Terms of Service

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter this agreement. Anyone under 18 may not create an account, access, or use Velart, even with permission from a parent or guardian. By registering or using the service, you represent that you are at least 18.

2. Accounts and security

Provide accurate account information, keep your credentials secure, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account unless applicable law provides otherwise. You may not sell, rent, share, or automate access to an account in a way that bypasses limits or security controls.

3. The service

Velart uses automated and third-party systems to create images and videos from prompts and reference material. Results may be inaccurate, unexpected, similar to results created for others, delayed, unavailable, or unsuitable for a particular purpose. Features, models, prices, limits, and availability may change. Do not rely on generated material for medical, legal, financial, safety-critical, identity-verification, or other high-risk decisions.

4. Your inputs

You keep your rights in prompts, reference images, and other material you submit ("Inputs"). You represent that you have every right, permission, and lawful basis needed to submit and process them. You grant Velart and its service providers a worldwide, non-exclusive, royalty-free license to host, copy, transmit, transform, and process Inputs only as needed to provide, secure, maintain, and enforce the service.

5. Generated outputs

As between you and Velart, and to the extent permitted by law, you own any rights Velart may have in images or videos generated for you ("Outputs"). Velart does not promise that an Output is unique, protectable by copyright, non-infringing, accurate, or cleared for commercial use. Other users may receive similar material. You are responsible for reviewing Outputs and obtaining any permissions needed before publishing, selling, advertising with, or otherwise using them.

6. Acceptable use

You may not use Velart, Inputs, or Outputs to create, facilitate, request, distribute, or promote content or conduct that is unlawful, abusive, deceptive, or harmful, including:

• pornographic or sexually explicit depictions of actual or identifiable people, child sexual abuse material, any sexualized depiction of a minor, grooming, or exploitation of any person;
• non-consensual intimate imagery, sexual deepfakes, stalking, doxxing, blackmail, harassment, or credible threats;
• fraud, impersonation, identity theft, deceptive political persuasion, fabricated evidence, or misleading claims that synthetic media is authentic;
• material that infringes copyright, trademark, privacy, publicity, confidentiality, or other rights;
• hateful content, targeted abuse, or content that encourages violence or discrimination against protected persons;
• instructions or material primarily intended to enable malware, unauthorized access, weapons misuse, trafficking, or other serious wrongdoing;
• attempts to bypass safeguards, probe private systems, scrape the service, overload infrastructure, reverse engineer restricted components, or evade usage limits;
• sale or transfer of access, credits, or Outputs in a way that misrepresents their origin, rights, authenticity, or endorsement.

7. Credits, payments, and refunds

Credits are limited, revocable service units used only inside Velart; they are not money, cryptocurrency, stored value, or transferable property. NOWPayments processes cryptocurrency payments. Credits are added after full payment is confirmed; partial payments, network fees, price movement, wrong-chain transfers, and wallet errors may not be recoverable. A failed generation is normally returned as service credits. Credits used for a successfully submitted or completed generation are generally consumed and non-refundable, except where required by law or expressly stated at purchase. Statutory cancellation, refund, and consumer rights are not limited by this paragraph.

8. Safety review and enforcement

We may use automated or human review to investigate abuse, security incidents, payment disputes, and reported content. We may reject a request, remove or restrict material, preserve relevant evidence, limit features, suspend an account, or notify authorities when reasonably necessary to protect people, comply with law, or enforce these Terms. We are not required to pre-screen every Input or Output.

9. Copyright complaints

Respect intellectual-property rights. The Copyright & DMCA Policy is incorporated into these Terms. Velart may remove or disable access to material in good faith, notify the affected user, accept a valid counter-notice where applicable, and terminate repeat infringers in appropriate circumstances. Submitting a knowingly false complaint or counter-notice may create legal liability.

10. Third-party services

Velart depends on providers for authentication, hosting, storage, AI processing, content delivery, security, and payment processing. Their systems and terms may affect availability and processing. Velart is not responsible for a third party's independent products or for blockchain transactions outside our control, but we remain responsible for our own obligations under applicable law.

11. Disclaimers

To the maximum extent permitted by law, Velart is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted service, permanent storage, any particular generation result, or that safeguards will catch every prohibited request. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Velart and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities. Our aggregate liability for claims arising from the service will not exceed the greater of USD 100 or the amount you paid to Velart in the six months before the event giving rise to the claim. These limits do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or liability that law does not allow us to limit.

13. Your responsibility to Velart

To the extent permitted by law, you will defend and indemnify Velart and its operator against third-party claims, losses, and reasonable costs arising from your Inputs, your use or distribution of Outputs, your unlawful use of the service, or your material breach of these Terms. This does not require you to indemnify Velart for its own fraud, willful misconduct, or violation of law.

14. Suspension and termination

You may stop using Velart and request account deletion. We may suspend or terminate access for a material or repeated breach, legal requirement, security threat, non-payment, or serious risk to others. Where reasonable, we will provide notice and an opportunity to appeal. Terms that by their nature should survive—including payment, ownership, disclaimers, liability, evidence preservation, and dispute provisions—remain effective.

15. Changes to these Terms

We may update these Terms to reflect changes in the service, law, or risk. We will post the new date and provide additional notice for material changes where required. Changes apply prospectively. Continuing to use Velart after the effective date means you accept the revised Terms, unless applicable law requires a different form of consent.

16. General terms

Applicable mandatory law and consumer protections continue to apply. If part of these Terms is unenforceable, the remaining provisions remain in effect and the invalid part will be limited only as necessary. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, or transfer of the service while preserving applicable rights. These Terms, the Privacy Policy, Cookie Policy, Copyright & DMCA Policy, and purchase disclosures are the entire agreement about Velart.
